These Terms and Conditions (“Terms”) govern your access to and use of the GT Apparelss website, products, and sourcing services. By accessing our website, submitting an enquiry, approving samples, or confirming an order, you agree to be bound by these Terms. If you do not agree, please refrain from using our website or services.
GT Apparelss may update these Terms at any time. Continued use of the website or services after changes are posted constitutes acceptance of the revised Terms. These Terms apply to visitors, buyers, brand representatives, and any person acting on behalf of a business entity.
Services Description
GT Apparelss provides apparel buying and sourcing support, including factory coordination, sampling, merchandising follow-up, quality checkpoints, and related commercial assistance for knitted, woven, kidswear, and home textile programmes. Exact scope for each engagement will be confirmed in quotations, purchase orders, or written correspondence.
Orders & Pricing
- All orders are subject to material availability, production capacity, and written confirmation at the time of booking.
- Prices shared by email, WhatsApp, or quotation are indicative until confirmed via official quotation or proforma invoice.
- Minimum order quantities (MOQ) apply and may vary by product category, fabric, colour count, and customization complexity.
- Custom development (special colours, finishes, trims, or constructions) may affect pricing and lead time.
- Once an order is confirmed and accepted by GT Apparelss, it constitutes a binding commercial commitment between the buyer and the company.
Sampling & Approvals
- Development samples, fit samples, SMS, and lab dips are produced based on buyer briefs and available capacity.
- Bulk production proceeds only after relevant approvals are confirmed in writing (or as otherwise agreed).
- Delays in buyer approvals may extend production and shipment timelines proportionally.
- Sample charges, courier costs, and development fees may apply and will be communicated in advance where relevant.
Payment Terms
- Advance payment is typically required before production begins; balance payment is due before dispatch unless otherwise agreed in writing.
- Accepted methods include bank transfer and other channels communicated at the time of order.
- Applicable taxes (including GST where relevant) are charged as per prevailing rates and shown on invoices.
- International transactions may be subject to banking charges, currency conversion, and documentary requirements.
- Delayed payments may postpone production scheduling or shipment release.
Delivery & Shipping
- Production and delivery timelines are estimates based on order volume, material booking, and factory schedules.
- Indicative SMS lead time is approximately 15 days; bulk production commonly ranges 60–70 days from confirmation, subject to complexity.
- Shipping and freight charges are generally borne by the buyer unless otherwise agreed in writing.
- Risk of loss or damage transfers to the buyer once goods are handed to the carrier, unless a different Incoterm is agreed in writing.
- Buyers must provide accurate shipping instructions and destination details. Delays caused by incomplete information are not the responsibility of GT Apparelss.
- Force majeure events (including natural disasters, strikes, regulatory changes, epidemics, or material shortages) may extend timelines.
Quality & Claims
- We strive to meet agreed specifications. Industry-standard tolerances for measurements, shade, GSM, and shrinkage may apply.
- Quality claims should be raised promptly after receipt, with photographic or video evidence, invoice references, and lot details.
- Claims related to transit damage should also be raised with the carrier as applicable.
- Custom-manufactured goods produced to approved specifications are generally non-returnable and non-refundable.
- GT Apparelss will review valid claims in good faith and propose a commercially reasonable resolution.
Cancellation Policy
- Orders may be cancelled before production and material commitment begin, subject to any agreed administrative or development costs already incurred.
- Once yarn, fabric, trims, dyeing, cutting, or sewing has commenced, cancellation is generally not permitted and full payment obligations may apply.
- Partial cancellation after production start is not permitted unless expressly agreed in writing.
Intellectual Property
Buyers retain ownership of their brand assets, tech packs, and approved designs. Buyers warrant they have rights to any artwork, logos, or designs submitted for production. GT Apparelss shall not be liable for IP disputes arising from buyer-supplied materials. Website content belonging to GT Apparelss may not be copied or reused without permission.
Limitation of Liability
To the maximum extent permitted by law:
- GT Apparelss shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or goodwill.
- Our aggregate liability related to a specific order shall not exceed the amount paid by the buyer for that order.
- Buyers are responsible for verifying that products are suitable for their intended market, end use, and regulatory requirements.
Governing Law
These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts in Tirupur / Tamil Nadu, unless otherwise required by mandatory law.
